This Country Preparing Beach Smoking Ban, British Tourists Out of Luck

Enjoying sunset at the beach while lighting a cigarette might soon become a prohibited act in Spain. The matador country's government has just proposed a new draft bill that will tighten smoking and vaping regulations in outdoor spaces, including beaches popular with tourists.

Reported by Travel + Leisure on Friday, September 26, 2025, this draft regulation was proposed by the current ruling left-wing coalition government. 

Its goal is simple but firm: protecting public health and curbing the resurgent smoking habit among teenagers and young people.

“Public health will always be our priority above personal interests. Everyone deserves clean air and the chance to live longer and with better quality,” stated Spanish Health Minister Monica Garcia.

If approved by parliament, the new rules will ban smoking and vaping in several popular locations, ranging from beaches, restaurant and bar terraces, bus stops, public transport stations, to stadiums. 
University campuses, public swimming pools, and commercial vehicles are also on the list of prohibited areas.

This policy could significantly impact foreign tourists, especially those from the UK. 

In 2023 alone, approximately 5.7 million UK tourists vacationed in Spain, favouring destinations like Tenerife, Lanzarote, and Gran Canaria. 

Until now, Spain's cheaper tobacco prices have been an added attraction for them.

However, it's not just about locations. The bill also bans the sale of disposable vapes, restricts tobacco product advertising in almost all media, and reinforces the ban on selling tobacco products to minors under 18. Parents could also face sanctions if their child is caught smoking or possessing tobacco products.

No Small Fines

The Spanish government has prepared a tiered fine structure based on the severity of the offense.

- Minor violations, such as smoking in prohibited areas, could incur fines of 100–600 euros (approx. Rp1.8–10 million).

- Serious violations, like selling cigarettes individually or repeated offenses, could attract fines of up to 10,000 euros (Rp170 million).

- Very serious violations, such as tobacco advertising and promotion, could face maximum fines of 600,000 euros or around Rp10.5 billion.

Not only regular cigarettes, but products like herbal cigarettes, nicotine pouches, and heated tobacco devices will also be treated the same under this new regulation.

With such strict policies, Spain's beaches, once familiar with cigarette smoke, might soon truly only retain the scent of the sea and the fresh Mediterranean breeze.
